Understanding Child Custody Laws in Osceola County: What Parents Should Know

When parents no longer live together, they must decide how to care for their child. This includes where the child will live, who will make important decisions, and how much time each parent will spend with them. In Florida, child custody laws help parents and judges figure out the best plan for the child’s well-being.

At Ramjeawan Law Group, P.A., we know this can be a stressful and scary process for many parents. In addition to worrying about how this will affect their child, parents also have questions like, “Will I have to go to court, and do I need a lawyer?” This article will explain things so parents can understand and know what to expect.

What Is Child Custody in Florida?

In Florida, the law does not use the word “custody” as much anymore. Instead, it talks about time-sharing and parental responsibility. Florida courts try to keep both parents involved in the child’s life for the best interest of the child–unless one parent is unfit (such as a history of abuse or neglect).

Time-sharing is the schedule that decides when the child spends time with each parent. Examples include equal time-sharing, where the child spends about the same amount of time with both parents, and majority time-sharing, where one parent has the child more often and the other parent has visits.

Parental responsibility involves making important decisions for the child, such as what school they will attend, what medical care they receive, what extracurricular activities they participate in, and even what religion they practice. Florida courts usually order shared parental responsibility, which means both parents must work together to make big decisions. However, if one parent cannot make safe choices, the court may give one parent sole responsibility.

How Do Florida Courts Decide Child Custody?

Florida courts base custody decisions on the “best interests of the child” standard, as Florida Statute Section 61.13 outlines. All custody cases require a legally approved parenting plan detailing parental responsibilities, time-sharing schedules, and communication guidelines. If parents agree on a plan for raising their child, they can create a parenting plan and submit it to the court. A judge will review and approve it if it is fair and aligns with the child’s best interest.

If parents cannot agree on a parenting plan, the court may require mediation. Mediation is when both parents meet with a neutral person (a mediator) who helps them work out a fair plan. The mediator does not take sides but helps parents talk things through. If mediation does not work, the case goes to court, where a judge will decide.

Do You Need a Lawyer for Child Custody in Osceola County?

Not every parent needs a lawyer but having one can make the process easier and help ensure fairness. You may not need a lawyer if both parents agree on a fair time-sharing plan, the child’s care, and an understanding of how to fill out legal forms and file them with the court.

You should get a lawyer if you and the other parent cannot agree on time-sharing, the other parent has a lawyer, there are concerns about the child’s safety (such as abuse or neglect), or you are unsure how to protect your rights.

In Osceola County, the Family Court Case Management provides assistance to self-represented parties. However, they cannot provide legal advice, so it is recommended that you consult an attorney. ninthcircuit.org
